Terms and Conditions
1. General
The property known as: 1,2, 3 and 4 bedroom villas are offered for holiday rental, subject to confirmation from Samui Boat Lagoon Property Co Ltd. – “the Owner’s representative” to the renter “the client”. The booking terms and conditions form the sole contract between the Samui Boat Lagoon Property Co Ltd and the lead person whose full name and address is on the booking form, who must be over 18 years of age and who shall be deemed to accept the terms & conditions on behalf of all the persons herein.
2. Bookings
2.1 Provisional confirmations of availability and rates
Upon receipt of a request for availability, the property rates and the amount of deposit required will be advised. Property rental rates are quoted on a daily basis in THB and include airport transfers, daily maid service, gardening and pool services, electricity, gas and water. The villa is fully equipped with linen, towels, crockery, utensils and an initial supply of soap and toiletries.
2.2 Exclusions and additional charges
The rates quoted do not include baggage handling, gratuities, vehicle rental, food and beverage, personal items and other expenses. Any excessive cleaning, excessive use of air conditioning, damage to fixtures and fittings or replacement of breakages. Fair wear and tear accepted.
2.3 Initial deposits
A completed booking form and an initial deposit of 25% of the total charge is required to confirm a booking, this is non refundable. For bookings made within 30 days of arrival, full payment is due at the time of the booking this is non-refundable. For non-refundable promotional rate 100% is charged at the time of booking.
3. Payment
3.1 Method of payment
We accept payment by bank transfer, or by credit card (Mastercard or Visa) Amex is also accepted with a 3.5% charge.
For bank transfer the only account name would be ‘Samui Boat Lagoon Property Co Ltd’
3.2 Payment due date
All booking payments are non-refundable. Payment of the outstanding balance must be received at least 30 days prior to arrival. If we do not receive the balance by the due date, we reserve the right to cancel the booking and cancellation charges will apply. For bookings made within 30 days of arrival, full payments are due at the time of the booking.
3.3 Payment due date
For Non-refundable bookings 100% payment is required at the time of booking. For other booking policy payment of the outstanding balance must be received at least 30 days prior to arrival. If we do not receive the balance by the due date, we reserve the right to cancel the booking and cancellation charges will apply. For bookings made within 30 days of arrival, full payments are due at the time of the booking.
4. Cancellation and Amendments
4.1 Cancellation
You may cancel your reservation at any time by notifying us by email. In the event of cancellation or if we cancel the booking due to non-payment of the balance by the specified date the following cancellation charge shall apply.
Between the booking date 30 days prior to arrival – Deposit charged.
Between 30 days prior to arrival and the arrival date – Full payment charged.
Non-refundable bookings 100% cancellation charge.
We can often hold a booking in credit for guests for 12 months in the event of cancellation should the cancellation be due to unforeseen circumstances. This is subject to villa availability on new dates.
4.2 Amendments
Requests for any amendment must be advised in by email.
5. Arrival and Departure Times
Check in time is 14:00 and the check out time is 12:00 noon.
We will arrange for our representative to collect you from the airport on arrival and return you to the airport at the end of your holiday. If we are required to make more than one journey each way due to different flight arrival/departure times an additional charge will be levied. Consideration is given where possible for early flight arrival and late departure times. Use of transfer is at the guest’s own risk.
6. Alterations or Cancellation By Us
In the unlikely event that we have to make any changes to confirmed bookings you will be advised by email at the earliest possible date.
If the property is damaged or rendered unusable, or if for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the property we will endeavor to provide an alternative property for the duration. We shall not be liable for any further obligations or claims whatsoever.
7. Registered Guests
Only those persons stipulated on the booking form may reside at the property as guests. Please notify us of any changes you wish to make. The number of people staying at the property including children and extra beds, must not exceed 1 bedroom villa (3 people),, 2 bedroom villa (5 people), 3 bedroom villa (7 persons), 4 bedroom villa (8 people). We can offer 1 extra bed per villa (1 and 2 and 3 Bedroom villa) for children over 2 years old this is at a cost of 1000 THB/night. For children 2 years and under, use of cot or existing bed is free of charge.
Should our property manager find that the number of people staying at the property exceeds that on the booking form, the additional guest(s) will be subject to a per night surcharge or asked to vacate the property forthwith.
No camping permitted in the grounds of the property and no pets allowed.
Smoking is not allowed inside the bedrooms and bathrooms, though it is permitted outside on the terrace. Your cooperation is therefore requested and appreciated.
The lead person is responsible for the conduct and appropriate behavior of all guests residing at the property. Should any guest(s) not behave in an appropriate manner our property manager has the absolute discretion to ask the offending guest(s) to vacate the property forthwith. It is absolutely prohibited for guests to allow prostitutes, illegal or immoral activities within the private boundaries of the property.
8. Insurance
It is a condition of booking that all guests are covered by comprehensive travel insurance including, but not limited to cancellation/curtailment, medical emergency, repatriation and associated expenses, loss of, and damage to personal property and belongings, third party liability, locally procured third party services including, but not limited to watercraft, water sports and vehicle rental. All personal belongings need to be locked in safe provided in all villas. We strongly recommend this be arranged once your reservation is confirmed. All bookings are non-refundable and strongly advise guests to take out travel insurance at the time of booking.
9. Liability Release
We accept no responsibility or liability for death, personal injury, sickness, accident, delay, loss of luggage or any other loss or misadventure. We accept no responsibility or liability for any loss or damage or alteration in the terms of the booking caused by events beyond our control, including but not restricted to war, terrorist activity, civil commotion, flight delays or cancellation, airport closure, plane crash, adverse weather conditions, virus outbreak, fire, flood and industrial dispute.
We accept no responsibility or liability for the failure of public services, such as electricity or water supply. Nor for the consequences of the actions or omissions of persons who may supply or control main services, or any actions taken in the vicinity of the property reserved, by any authority or persons over which we have no control. We cannot accept any liability for the failure of the air-conditioning, broadband connection, pool filtration system or any household appliance. Urgent steps will be taken for a local engineer to rectify any problem.
We accept no responsibility or liability for your personal safety. Use of the property amenities including the villa private pool and communal resort pool is entirely at your own risk.
Any vehicle use (including shuttle service, car and motorcycle hire) is entirely at guest own risk and Samui Boat Lagoon Property Co Ltd accepts no responsibility for any accident, injury, death occurring. Guests should make sure they acquire an international driving license before rental as insurance may not cover without this document.
We accept no responsibility for any dispute arising from the use of Online Agents (OTAs) or other booking agencies.
10. Linens and Towels
Linens and towels are provided and are changed on a regular basis. Outside laundry services are available for a small charge and must be paid for at the time.
11. Complaints
The properties described in this website are provided in good faith and we accept no liability for any errors or omissions.
Should you experience any problems whatsoever with the villa during your stay please contact our property manager. We will do our best to assist and rectify the matter as soon as practically possible. We cannot resolve a problem for you unless we are notified at the time. Please give us the opportunity to correct matters. No action can be taken or liability accepted for any complaints received after you have vacated the property. We aim to resolve complaints within a reasonable period of time, the details of which will be kept confidential to only the parties involved.
12. Third Party Links
The Site may include links to other websites or resources that are not operated or prepared by Samui Boat Lagoon Property Co Ltd. We have no control over such sites and resources and we will not accept responsibility for them or be liable for any loss or damage caused or alleged to be caused by or in connection with your use of them.
Samui Boat Lagoon Property Co Ltd is not responsible for the content or accuracy of any off-site pages, which include but is not limited to advertisers of the Site. Use of these external websites or resources will be at your own risk and subject to the terms of use and service contained within each of such sites.
13. Applicable Law
These conditions and any contract to which they apply are governed in all respects by Thai Law and the Thai Law Courts only shall have sole jurisdiction in relation to any claim or dispute arising out of or connected with them.
